1. Who and what
These terms apply to this website and to the software SoundManager for Windows (“the app”), both provided by Finnian Alexander Wisak, Austria (“I”, “me”). By downloading or using the app you accept them. If you do not agree, please do not use the app.
2. Free of charge
The app is provided free of charge. There is no payment, no subscription, no trial period and no account. No contract for payment is concluded between you and me.
3. What you may do
- Install and use the app on as many of your own Windows PCs as you like, privately and at work.
- Create, export, import and share your own profiles.
- Show the app in videos, streams, articles and reviews, including screenshots.
- Link to this website and pass the link on.
4. What you may not do
- Sell the app, rent it out or bundle it with a paid product.
- Offer the installer for download elsewhere in a modified form, or under a different name.
- Remove or change the name, the logo or the notices of authorship.
- Use the app in a way that violates the law or the rights of others.
All rights not expressly granted here remain with me.
5. No warranty
The app is a personal project and is provided as it is. I build and test it with care, but I cannot promise that it is free of errors, that it works with every app, device or Windows version, or that it will be maintained forever. Audio software changes system settings while it runs; the app restores them when you quit it, and you use it at your own risk.
6. Liability
Because the app is given away for free, my liability is limited as far as the law allows. I am liable without limit for damage caused intentionally or through gross negligence, and for injury to life, body or health. For slight negligence I am not liable, as far as this is legally permitted. Mandatory consumer protection rules, in particular those of the Austrian Consumer Protection Act (KSchG), remain unaffected.
7. Availability
I try to keep this website and the download available, but I do not guarantee it. I may change, pause or end the site or the app at any time.
8. Third parties
The app works together with Windows and, if you own one, with the Stream Deck software. Their own terms apply to those products. SoundManager is not affiliated with their makers; see the imprint for trademark notices.
9. Your data
The app collects no personal data. What this website processes is described in the privacy policy.
10. Changes to these terms
I may update these terms, for example when the app gains a feature that needs explaining. The version published here on the day you download the app applies to that version of the app.
11. Law and place of jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory protections of the country you live in remain in force, and you may bring a claim where you live.
12. If something does not hold
Should a single provision of these terms be invalid, the rest stays in effect.
