1. Who is responsible

2. When you visit this site
To deliver a page, the server that hosts this site has to process the request your browser sends. This includes your IP address, the date and time, the page or file requested, the referring page if your browser sends one, and your browser and operating system. The hosting provider keeps this in server log files for a limited time to keep the service secure and stable.
Legal basis: Art. 6 (1) (f) GDPR. The legitimate interest is the secure and reliable operation of the site. I do not combine these logs with other data and do not use them to identify you.
The site runs on a virtual server that I rent and administer myself. The company that operates the data centre has no access to the content beyond what running the server requires.
3. Cookies and local storage
This site sets no cookies. It stores two small entries in your browser's local storage, which stay on your device and are not sent anywhere:
sm-theme: whether you chose the light or the dark theme.sm-consent: your choice in the consent banner and when you made it.
Both are technically necessary to show the site the way you set it up (§ 165 (3) TKG 2021) and need no consent. You can delete them at any time through your browser settings.
4. Visit statistics
At the moment this site runs no statistics at all, whatever you choose in the consent banner. Should that change, a statistics script will only ever be loaded after you chose “Allow statistics”, it will work without cookies, and this section will name the service. Legal basis would be your consent, Art. 6 (1) (a) GDPR. You can change your choice at any time: .
5. Fonts and other resources
All fonts, scripts, images and animations are served from this site itself. No font service, content delivery network, map, video platform or social media plug-in is embedded, so your browser contacts no third party when you read a page here.
6. When you write to me
If you use the contact form or send an email, I process your name, your email address and your message to answer you. Legal basis: Art. 6 (1) (f) GDPR (my interest in answering enquiries) and, where you ask for it, your consent under Art. 6 (1) (a) GDPR. I delete the correspondence once your request is dealt with, unless the law requires me to keep it longer.
The form protects itself against automated spam with a hidden field and a timing check. No third-party captcha is used and nothing is sent to another company for this.
7. Downloading SoundManager
The download is not open yet. Once it is: The installer is delivered like any other file on this site; the server log entry described in section 2 is created. You do not have to register and no licence key is tied to you.
8. The app itself
SoundManager runs entirely on your PC. It has no account, no telemetry, no advertising and no update check that reports who you are. Profiles and settings are stored in a file in your Windows user folder. The app's control interface only accepts connections from your own machine. Audio is processed in memory and is never recorded, stored or transmitted.
9. Who receives data
Only the hosting provider as a processor, bound by a data processing agreement (Art. 28 GDPR). I do not sell data and do not pass it on for advertising. Data is not transferred to countries outside the EU or EEA unless the hosting provider named above states otherwise.
10. Your rights
Under the GDPR you have the right to
- access to the data stored about you (Art. 15),
- rectification of incorrect data (Art. 16),
- erasure (Art. 17),
- restriction of processing (Art. 18),
- data portability (Art. 20),
- object to processing based on legitimate interests (Art. 21), and
- withdraw a consent at any time with effect for the future (Art. 7 (3)).
A message to the address in section 1 is enough. There is no automated decision-making and no profiling.
11. Right to complain
If you believe that the processing of your data violates data protection law, you can lodge a complaint with a supervisory authority. In Austria this is the Österreichische Datenschutzbehörde, Barichgasse 40–42, 1030 Vienna, dsb.gv.at.
12. Changes
If the site changes in a way that affects your data, this policy is updated and the date at the top changes with it.
